In his high-profile pursuit of questionable business practices in the student loan industry, New York’s Andrew Cuomo is following the model of the activist, consumer-oriented state attorney general. Contrary to popular belief, this role was not invented by his predecessor Eliot Spitzer, now New York governor.

Others view it as the liberal reaction to the conservatism of Ronald Reagan. State AGs reconfigured their historic caretaker role into using litigation to change the status quo — an approach called “regulation through litigation.”
