Gov. Bill Richardson signed the order in October that requires employers with six or more workers to contribute to a state-run fund that will help pay for covering the uninsured or offer health insurance to their workers even if the business doesn’t pay any of the costs.
The coverage mandate is to be phased in on state contractors in mid-2008.
Sen. Leonard Lee Rawson, R-Las Cruces, said he believes the order bypassed the legislative process and violated the separation of powers.
