“A lawsuit that sought to disqualify Democrat Jerry Brown from the state attorney general's race failed to derail his campaign after a judge ruled the case would not be heard until after the Nov. 7 election. Republican officials argue that Brown is ineligible for the office because he doesn't meet a basic requirement that candidates must be admitted to practice before the state Supreme Court for at least five years immediately preceding the election.

According to the State Bar's Web site, Brown was admitted to the bar in 1965, went inactive in 1992, reactivated in 1996, went inactive again in 1997 and has been an active member from 2003 to the present. That gives him less than the required experience, according to the complaint filed last week in Sacramento County Superior Court seeking to block county election officials from counting votes for Brown. … 

Judge Shelleyanne Chang did not rule on the merits of the case Tuesday. Rather, she told attorneys that, following normal procedures, the suit should not be heard until 16 days after the defendant is served with the suit, which has not yet happened.”
