OH: Sexual Harassment Details Keep Coming In

In his sworn statement, Dann acknowledged his scheduler and sometimes overnight guest, Jessica Utovich, might have had a key to the condominium where he lived with Anthony Gutierrez, fired general services director, and Leo Jennings III, fired communications director. But Dann insisted he didn’t give it to her.

As to the great controversy about whether Utovich was wearing “pj’s” in Dann’s condo — which Dann insisted never happened — that description appears only in the equal-employment officer’s notes of her interview of one of the harassment victims. The victim herself always used some variation of “sweats” when describing the incident. Even Dann himself confirmed that was Utovich’s usual “not-working” outfit.

It wasn’t just questions about whether she spent the night at Dann’s condo that Utovich refused to answer. After she talked about meeting Dann and his chief of staff, Edgar C. Simpson, at Zeno’s, and later partying with office staff members at the Victorian Village bar, she was asked, “People still smoke there?” Her reply: “No comment. Sorry.”

Later, asked if Gutierrez’s often-vulgar language offended her, she answered, “I’ve never felt uncomfortable with him, but probably because I swear as much as he does.”

The attorney general’s director of human resources recommended that Gutierrez immediately be transferred when the office heard a second time in early March that he was sexually harassing female employees. Why didn’t Simpson make the move?
