Rite Aid Corp. has agreed to pay New Jersey up to $650,000 to settle a lawsuit charging that dozens of its stores in the state – including several in Hudson County – sold expired infant formula, baby food, and over-the-counter medications.
Of the 42 stores cited for allegedly selling expired items, 10 – nearly 25 percent – are located in Hudson County, including three each in Jersey City and Bayonne.
In addition, the Attorney General’s Office accused Rite Aid of failing to post its return policy, or posting it in an obscured manner in at least 31 stores, eight of them in Hudson County.
“Expired products have no place on the shelves of New Jersey stores, and as this settlement makes clear, the law requires Rite Aid to make sure product dates are checked and requires that out-of-date products are not offered for sale,” state Attorney General Anne Milgram said yesterday.
Rite Aid, based in Camp Hill, Pa., admitted no wrongdoing, her office said.
A company spokeswoman, Cheryl Slavinsky, said Rite Aid has implemented policies to periodically inspect merchandise to make sure expired products aren’t being sold. She said price accuracy is also being monitored.
Under the settlement, Rite Aid is to pay $475,000, representing a penalty, legal fees and investigative costs. If terms are violated over the next year, Rite Aid would pay an additional penalty of $175,000.
