Attorney General Wayne Stenehjem says Fargo should be able to enact a smoking ban for playgrounds.
Stenehjem says state law is written to allow local smoking ordinances to be tougher than the state ban.
He says the only question is whether the Park District has the power to create an ordinance, or if it would have to work with the city.
