This is a loophole that needs closing. It’s a hassle that it has to happen, but just the same it’s better that it does. No more novel defense theories coming from the bench, or the scumbags who are dead to rights on soliciting minors. From AL.com:
An undercover sting catches an online child sex predator but the charges are dropped because the would-be victim – a cop – is not a child.
Alabama Attorney General Troy King said Monday he’s pushing a bill that makes the intent to lure a child for immoral purposes punishable regardless of whether a child is involved. The measure would also expand Alabama’s child solicitation law to include electronic communications other than online as new technologies develop.
“Many people are not aware that when an undercover officer goes online posing as a child, identifies, arrests and charges a predator, there are courts in this state that routinely dismiss these charges on the basis that it was not a child but an undercover policeman that was actually soliciting,” King said in Huntsville during a stop to promote his 2009 legislative agenda.
