GRETA VAN SUSTEREN, FOX NEWS HOST: Another state another battle. Missouri Lt. Governor Peter Kinder locking with the federal government, but this time it isn’t illegal immigration, it is health care. Lt. Governor Kinder joins us live. Good evening, sir.
LT. GOV. PETER KINDER, R-MO.: Good evening, and thank you for having me back, Greta.
VAN SUSTEREN: Happy to have you back. I’ve read your complaint quite lengthy, very long. Tell me, what is — you essentially have a couple arguments that you are saying the health care bill is unconstitutional. What are they?
KINDER: I heard the very fine interview you did last night with Arizona Senator Jon Kyl in which he made the distinction between a facial challenge on a statute, which is what the attorney generals in the other states have filed, and the distinction with our case that makes it different and unique is that we filed an “as applied” challenge on constitutional grounds.
That is the attorney general generals are Florida, Virginia and other AG’s in those cases are challenging the new federal health care reform law on its face. And our challenge differs in that we are not suing as the state of Missouri, we are suing with three plaintiffs who join me, three female citizens of Missouri who join me as plaintiffs in our case today.
