Feds pull Spitzer’s security clearance

From Deep Background:

The FBI and Homeland Security officials revoked Governor Eliot Spitzer’s security clearance early this week as the criminal investigation into Spitzer’s alleged use of prostitutes broadened, according to officials familiar with the case. As a result, Spitzer no longer has access to classified intelligence and security briefings, federal officials told WNBC on condition of anonymity. A spokeswoman for Spitzer did not return calls for comment.

How Spitzer’s Resignation Affects Albany

The wily Democratic majority leader of the Assembly, who took a back seat on many issues to Mr. Spitzer, could fill a power vacuum left by the governor’s departure, at least during Mr. Paterson’s transition. “Silver knows when to play and when to lie low,” said Alan Chartock, a University at Albany professor.

The Senate majority leader gets along well with Mr. Paterson, the former Senate minority leader. The Republicans now hold 32 seats in the senate, to the Democrats’ 30, so the loss of one seat will create a tie. But because the position of lieutenant governor will not be filled for the remainder of Mr. Paterson’s term, and because the lieutenant governor casts tiebreaking votes in the Senate, the question of who controls the Senate may remain an open one, even if the Democrats pick up a seat.

NY: State Budget Held Up By Spitzer Scandal

STATEN ISLAND ADVANCE — While New York state and the country remain fixated on the call-girl scandal embroiling Gov. Eliot Spitzer, a piece of crucial Albany legislative business looms: Passing the state budget. The budget deadline is the end of the month, but one government observer said yesterday it would be “basically impossible” for lawmakers to begin meaningful negotiations as long as Spitzer’s situation is unsettled, especially if he has the threat of impeachment hanging over his head.

“I don’t see how negotiations could happen under those circumstances,” said Edmund McMahon, an expert in municipal budget, tax and reform issues, following an address at the Hugh L. Carey Center for Government Reform at Wagner College.

Wall Street Journal – Spitzer Refused To Admit Limits

Despite the thoughts of the Alan Dershowitz’s of the world, Mr. Spitzer broke the laws of his state – and of this nation. Of all people, Eliot Spitzer, who has a zero tolerance for wrongdoing in others, should have known. Guess he has a real blind spot on himself on these issues, much like another former Democrat A.G. from a small southern state who got caught up in his own extramarital scandal. Wait, we can now count FOUR former Democrat A.G.s who have been tripped up and had their legacies tarnished by cheating on their spouses. Who can name the three?

Mr. Spitzer coasted into the Governorship on the wings of a reputation as a “tough” public prosecutor. Mr. Spitzer, though, was no emperor. He had not merely arrogated to himself the powers he held and used with such aggression. He was elected.

In our system, citizens agree to invest one of their own with the power of public prosecution. We call this a public trust. The ability to bring the full weight of state power against private individuals or entities has been recognized since the Magna Carta as a power with limits. At nearly every turn, Eliot Spitzer has refused to admit that he was subject to those limits.

NY: Spitzer Investigation Politically Motivated?

Quick show of hands, who remembers how they finally caught up with Al Capone? That’s right – they got him on financial misdeeds – not the other crimes he committed. You have hand it New York’s Democrat Governor Eliot Spitzer (who once thought himself more of a Ness and less of a Capone we’re sure), at least he didn’t make things worse for himself by denying any of the things that have happened here.

You read the coverage of this mess as it unfolds, and what comes into focus is a guy who thinks the laws of this country apply to everybody else – and not himself. A guy who has, apparently, repeatedly used the services of this online prostitution service – with little regard for family, public, or self. And who knows how deep and sinister this international prostitution ring really goes – it’s not like the people who run this thing are the bingo hall ladies from St. Agnes the Redeemer (not a real church). They’re, AT BEST, organized crime (think mob types), and possibly closer to folks with links to international terrorists. Think it’s a stretch? Give it time, something even more sinister will bubble to the surface on this whole mess.

Oh, and on the whole he’s resigning, he’s not resigning thing when this all broke. We can’t take credit for the thought, but will echo it. CNN’s Jeffrey Toobin made the point the other night that Spitzer’s lack of resignation is part of a plea bargaining strategy to have his charges reduced. In short, he’ll tell prosecutors that he’ll resign as Governor if they reduce the charges. That Eliot Spitzer, always thinking like a lawyer – that’s probably brilliant and clinical legal thinking, but seriously flawed political and personal thinking. We’re afraid this former Democrat A.G. is on a collision course with reality real quick.

Heck of a Valentine’s Day present Governor Spitzer gave himself isn’t it?

The top question that remains in the case as of Tuesday morning was whether Spitzer would resign as governor of New York. If he does, Lieutenant Governor David Paterson would take his place.

But there are also questions about whether the original investigation into Spitzer’s money transfers may have been politically motivated.

Spitzer made a lot of enemies on Wall Street when he was New York State Attorney General. His office was responsible for banks separating its investment banking and research functions, which Spitzer claimed were too close for ethical comfort. His investigations into market timing, where brokers made multiple or late trades in mutual funds for hedge fund clients, resulted in firms paying billions of dollars in fees.

NY: Cash Triggered Spitzer Probe

NEW YORK (AP) — Gov. Eliot Spitzer’s role in a prostitution scandal grew out of a public corruption inquiry triggered by his movement of large amounts of cash from several bank accounts to one that operated by a call-girl ring, a law enforcement official said Tuesday.

Spitzer was the initial target of the investigation and was tracked using court-ordered wiretaps that appear to have recorded him arranging for a prostitute to meet him at a Washington hotel in mid-February, the official said.

The official spoke to The Associated Press condition of anonymity because of the sensitivity of the investigation.

NY: Dem Governor Spitzer Caught On Wiretap; Apologizes To Family

The former Attorney General caught by the feds for his involvement with prostitution ring:

ALBANY – Gov. Eliot Spitzer has been caught on a federal wiretap arranging to meet with a high-priced prostitute at a Washington hotel last month, according to a person briefed on the federal investigation.

An affidavit in the federal investigation into a prostitution ring said that a wiretap recording captured a man identified as Client 9 on a telephone call confirming plans to have a woman travel from New York to Washington, where he had reserved a hotel room. The person briefed on the case identified Mr. Spitzer as Client 9.

Mr. Spitzer today made a brief public appearance during which he apologized for his behavior, and described it as a “private matter.”

“I have acted in a way that violates my obligation to my family and violates my or any sense of right or wrong,” said Mr. Spitzer, who appeared with his wife Silda at his Manhattan office. “I apologize first and most importantly to my family. I apologize to the public to whom I promised better.”
