Wanted to update our post from the other day about the West Virginia Chamber of Commerce’s T.V. spot highlighting a controversy that has erupted around Democrat A.G. Darrell McGraw and a $10 million legal settlement that some believe should be going to help West Virginia workers and the state’s Medicaid system. We challenged our SNS readers to help us find a copy of the video – and you delivered. Check out the spot that’s running in West Virginia right now, after the jump. Goes without saying that Republican A.G. candidates Dan Greear and Hiram Lewis are happy every time they this T.V. spot (that’s the heat McGraw is taking – a statewide TV spot taking him to task for spending money that belongs to state workers and Medicaid) running in West Virginia. We only wish WE could see it. If any of you SNS readers out there have seen the spot, or can capture it and post on YouTube (or send it to us too!) we’ll do our duty by putting the spot up here for the rest of our readers to see.
West Virginia Attorney General Darrell McGraw’s spending of millions in settlement money from a drug company has spawned a critical television ad paid for by two state business groups and a growing uproar in the state Legislature.McGraw’s office contends the money is being spent properly and that the ad is not as noble as it sounds. The office says it’s an obvious political attack in an election from the very businesses McGraw takes to court.

Darr-elllll, Darr-elll, Darr-elll….oh, sorry. We were just wondering what West Virginia would be like if the voters acted more like Mets fans. Attorney General Strawber…sorry, McGraw is in the crosshairs of his state’s editorial boards, and they will not be letting up. Expect solid candidates, both Republican and Democrat, to emerge to run against McGraw this year.
“Only the attorney general’s office could find itself in the position of bringing in an $11.6 million settlement for tax relief and being criticized,” Hughes said.Her comment involved the reaction to an announcement by Attorney General Darrell McGraw, who has tentatively settled in a lawsuit against two credit card companies. He bragged that $12.1 million of the amount to be paid by the companies will be used to grant tax relief to West Virginians. Later, it was determined that someone in the attorney general’s office miscalculated; the amount actually is $11.6 million.

Read the article – just read it – and tell us if you think West Virginia’s Democrat A.G. Darrell McGraw adheres to the money is power school of thought. Maybe McGraw wants to be the money and power guy to West Virginia, like this guy is to New York. Seriously though, our favorite candidate to take down McGraw in ’08, and this candidate could do it with cold calculation, is right here.
And what better topic to come up again in an election year than the disbursement of funds derived from lawsuits which Attorney General Darrell McGraw’s office has filed on behalf of the state.Under the glare of television lights and media reports, McGraw has made it a point in recent years to dole out millions in settlement funds to various public and private entities across the state. Legislators like to gripe and moan about it, say the attorney general shouldn’t be doing it, but at the end of the day they don’t do squat about it.

WV: Feds Want Money From AG’s Settlement

Federal officials have again threatened to withhold Medicaid funds from West Virginia over the state’s handling of a lawsuit settlement.
Attorney General Darrell McGraw, who negotiated the 2004 deal that yielded the state $850,000, plans to appeal the decision by the U.S. Centers for Medicare & Medicaid Services.
“We absolutely disagree with their point of view for a whole host of reasons,” Managing Deputy Attorney General Barbara Allen said Tuesday. “We do not believe this disallowance is proper.”

OPPONENTS of West Virginia Attorney General Darrell McGraw are trying to recruit Manchin administration general counsel Carte Goodwin to run against McGraw in next year’s Democratic primary.The loose-knit group that’s trying to recruit Goodwin is made up of representatives of state business groups, as well as conservative Democrats, who believe McGraw’s highly publicized and often successful lawsuits against businesses damage the state’s economic climate.

Group wants $2.2 million from OxyContin Settlement:
The business group, made up of state business and professional associations, on Tuesday demanded that McGraw send the fund $2.2 million won in a lawsuit against the maker of OxyContin.
“I doubt if we’ll even respond to their letter,” Fran Hughes, chief deputy attorney general, said Wednesday afternoon.

Where's The Honor in That?

After being named the worst state attorney general in the country, Connecticut’s Dick Blumenthal said it made him proud.
“I regard this title as a badge of honor — recognizing my relentless fights against big tobacco, air polluters, environmental law breakers and monopolistic predators,” Blumenthal said. Shew – can’t believe he didn’t call them evil doers.
Why was he labeled the worst of the worst by the Competitive Enterprise Institute? The criteria included… subcontracting lawsuits to former legal associates or campaign contributors; advocating courts to “rewrite statutes or stretch constitutional norms;” bringing lawsuits that “usurp” state and federal regulations or the powers given to Congress and state legislatures; and seeking to regulate conduct occurring in other states.
But lucky for Blumenthal, he’s not alone on the list – his other list mates include:
2. Bill Lockyer – now California’s Democrat State Treasurer
3. Elliot Spitzer – now New York’s Democrat Governor
4. Zulima Farber – New Jersey’s Democrat AG
5. Patrick Lynch – Rhode Island’s Democrat AG
6. Darrell McGraw – West Virginia’s Democrat AG
7. William Sorrell – Vermont’s Democrat AG
8. Lisa Madigan – Illinois’s Democrat AG
9. Peg Lautenschlager – no longer Wisconsin’s Democrat Attorney General
10. Tom Reilly – no longer Massachusetts’s Democrat Attorney General

As Washington State’s Republican A.G. Rob McKenna says:
“When states find a target, they often reach a settlement behind closed doors without the usual checks and balances in government,” McKenna said.
“A great deal of power has been wrapped up in multi-state litigation. What I say to my colleagues is: this is tremendous power, and we should be very judicious and careful that it is not overused or misused,” he said.
Very judicious indeed.
