MD: AG Vocal on Gay Marriage

When he first ran for attorney general on the platform of environmental activism, Douglas F. Gansler said advisers warned him he’d be tagged as a “tree-hugging liberal.” As he seeks re-election this year, and with an eye on the 2014 governor’s race, Gansler has embraced another left-of-center cause that he predicts is headed toward mainstream acceptance: gay marriage.

Gansler, a Democrat who faces no opponent yet this fall, is transforming his campaign trail into a sort of rally for gay rights, jumping off from his controversial opinion, issued in February, that Maryland should recognize same-sex unions legally performed in other states.

This spring, Gansler has taken many opportunities to trumpet his belief that the prohibition of gay marriage is “a clear violation of equal protection” — and has hastened to point out that no other statewide elected official in Maryland is as vocal in backing same-sex marriage.

MD: Delegate Moves to Impeach AG

An attempt to impeach Maryland’s attorney general devolved into a House of Delegates debate on parliamentary rules, leaving discussion of the impeachment itself to a House committee hearing later Wednesday afternoon.

Del. Don H. Dwyer Jr., R-Anne Arundel, has for months threatened to impeach Attorney General Doug Gansler after Gansler in January issued an opinion advising state agencies to recognize legal same-sex marriages in other states.

The opinion usurped the lawmaking power of the General Assembly, Dwyer bellowed on the House floor.

AG – Maryland can Recognize Same Sex Marriages

Attorney General Douglas F. Gansler released a long-awaited opinion Wednesday saying that Maryland should recognize same-sex marriages performed in other states, drawing cheers from gay-rights supporters and igniting immediate debate on a highly contentious issue in an election year.

With the ruling, state agencies will be required to extend all benefits that heterosexual couples enjoy to married gay couples. These could include health insurance expansion, spousal legal immunities, property rights, the ability to file wrongful-death suits and perhaps some tax benefits, experts said yesterday.

“There is no law in Maryland that says we don’t recognize out-of-state marriages between same-sex couples,” Gansler said. “Based on the law and the state of the law in Maryland and the Constitution of the United States, this is what the law is.”
