Democrat AG candidate Beau Biden likes multi-state litigation. In
fact, when asked to define what criteria he would consider when joining a
national class action suit, Biden responds:
I think that is a area that the Department of Justice needs to look
much more seriously at.
Some call it Class Action Litigation, but it’s really called
Multi-State Litigation and what it is is it’s where states see harm to
their consumers or to their citizens and pursue actions against companies who
rip us off.
And so, we have been one of the states that has been very slow to the
table on that kind of litigation.
We were one of the last states to the table on the tobacco litigation
– an action that I think almost every state joined in. And we were, had
to be prodded and cajoled – from the Department of Justice’s
perspective – to even enter into that litigation.
I think that it’s something that, if there’s harm to consumers – and other states see it
– we have an obligation, an obligation, to seek to redress that wrong and
recover money on behalf of the citizens of Delaware.
Environmental litigation is a somewhat different issue.
I think this Department of Justice hasn’t done a serious
environmental enforcement action in the last 12 years – and that’s
something I’m going to be very focused on.
