BPB has carved out a lucrative niche industry in recent years suing Big Pharma drug makers for off-label marketing of anti-psychotic drugs and holds an impressive track record of landing big payouts. That fact alone likely made BPB a lead pipe lock for McDaniel’s contract to sue the three.
The BPB founding partner has also honed in successfully on key party targets. One is the Democratic Attorneys General Association (DAGA), which raises $2 million annually to help make Democrats AGs in 31 states. Some of those Democratic AGs, notably McDaniel and Oklahoma’s Drew Edmondson, in turn hire private lawyers to litigate big-money cases for the state.
Not surprisingly, Bailey has been one of DAGA’s most generous donors over recent years. Online records show Bailey donated $25,000 to the association in 2005 and another $30,000 in 2006. He made the contributions through Ohio Attorney General Marc Dann, DAGA’s main fund-raiser who is reported to be angling for its chairmanship.
