So here’s what’s
playing out on the left coast today… Tom Del Beccaro, chairman of the Contra
Costa County Republican Party has filed a lawsuit against Democrat AG candidate
Jerry Brown. I know, the first reaction to something like this is “inside
3 weeks and filing a lawsuit – political stunt”. Maybe, but
the legal minds out in California, the independent, non partisan types, say
Beccaro might be on to something. His suit basically says that since
Brown reactivated his law license in May of 2003 – California Code Section12503
(my names Friday) “declares that no
person is eligible to be attorney general unless “he shall have been
admitted to practice before the Supreme Court of the state for a period of at
least five years immediately preceding his or her election to the office.”
Brown’s folks say
it’s a frivolous lawsuit.
The Poochigian folks say they’re not
party to the suit, but they support it.
And Kareem Clayton, a University of Southern California
Law School professor who specializes in election law, said Del Becarro may have
a point.
