The state Department of Consumer Protection has referred the case against Bowden Development LLC to the state attorney general’s office for expedited legal action on complaints alleging overcharging and faulty installation of modular homes.
The department opened a public hearing on four complaints against the business on June 17. DCP Commissioner Jerry Farrell Jr. said Tuesday that additional complaints have surfaced since the hearing, with the total number of complaints surpassing the reimbursement amounts available in the state’s New Home Guaranty Fund. The fund provides for compensation of up to $30,000 per contract for homeowners who can prove faulty or incomplete work by homebuilders and contractors.
Farrell said the hearings would be suspended in favor of court action under the direction of Attorney General Richard Blumenthal.
“Given the situation where the guaranty fund has these limits and these additional complaints have cropped up, I feel it is advisable to refer this matter to the attorney general’s office to pursue injunctive relief and much wider possible restitution to consumers than is possible under the guaranty fund limits,” Farrell said.
