At issue are robo-calls and the rules governing the proper behavior of Montana’s lawyers. Rules state that official disciplinary complaints against lawyers – like the kind Fox filed against Boland – are generally kept confidential until they are found to be legitimate.
In this case, Boland is the treasurer for a political-action committee called Citizens for Strong Law Enforcement. In the days just before the June primary election, the recently formed group ran robo-calls in favor of Bruner.
Both Bruner and Fox condemned the calls as illegal.
The law outlawing such calls is often ignored. No county attorney has filed a complaint against Boland.
Fox filed his complaint with the Office of Disciplinary Counsel, the investigative and prosecutorial arm of the Montana Supreme Court that regulates lawyers. In his complaint, Fox alleged that Boland knowingly broke the law prohibiting robo-calls, violated several campaign finance laws and is, therefore, guilty of professional misconduct.
“We’re not going to participate in these kinds of negative campaign tactics,” said Chuck Denowh, Fox’s campaign manager. “But we’re not going to sit back and let others attack us without defending ourselves.”
