Court Says Makers of Cold Medicine Not Responsible for Meth Epidemic

A federal appeals court Monday upheld the dismissal of a lawsuit seeking to hold makers of cold medicines containing ephedrine or pseudoephedrine financially responsible for Arkansas’ methamphetamine epidemic.

The 8th Circuit U.S. Court of Appeals in St. Louis affirmed a U.S. district judge’s dismissal of a lawsuit 20 Arkansas counties filed against Pfizer Inc., PDK Labs Inc., Warner Lambert Co., Johnson & Johnson and Perrigo Co.

The counties were seeking compensation for their expenses in dealing with the societal effects of the meth epidemic. A key ingredient in meth is ephedrine or pseudoephedrine.
