State Attorney General Henry McMaster on Tuesday issued a nonbinding legal opinion that the Legislature cannot bypass Gov. Mark Sanford in obtaining $700 million in federal stimulus funds and said the state could be headed for a “constitutional standoff” that the courts would have to resolve.
U.S. Rep. Jim Clyburn of South Carolina, the author of a clause that allows legislatures to vote to accept stimulus funds if their governors don’t, blasted McMaster’s opinion and accused Sanford, McMaster and U.S. Sen. Lindsey Graham of working to be sure the state’s children aren’t guaranteed a better education.
Sanford has until midnight Friday to accept the funds, and legislators and the governor have until then to work out any deal.
