Ohio has a law that says if candidates use more than $100,000 in personal funds for a campaign, their opponents have the option of exceeding state contribution caps and raising unlimited amounts from donors.
Sandra O’Brien, a Republican candidate for Ohio secretary of state, says that law is unconstitutional, and a federal judge appears inclined to agree.
O’Brien filed a lawsuit Thursday seeking to prevent Sen. Jon Husted, her opponent in the May 2010 GOP primary, from filing a “declaration of no limits” because she intends to use personal money in the race.
Judge Edmund A. Sargus Jr. of U.S. District Court in Columbus approved a temporary order to block any such filing and said in a court order that O’Brien “has shown that there is a substantial question of the constitutionality” of the law.
