A federal judge on Friday rejected a New York state lawmaker’s attempt to block his expulsion, saying the issue will be properly resolved by voters in a special election next month.
U.S. District Judge William H. Pauley III said Hiram Monserrate’s Queens district senate seat will only be vacant for a few weeks because Gov. David A. Paterson immediately set a March 16 special election to replace the Democrat.
The judge rejected arguments advanced by lawyers for Monserrate and several voters who sued the state after senators voted 53-8 last week to remove him because of a misdemeanor assault conviction. The lawyers argued that the voters were disenfranchised by his removal.
