Pushing back against a tide of Minnesota Republicans demanding the state sue over the federal health care bill, Democratic Attorney General Lori Swanson said Monday that she would not — and in fact would file legal papers supporting it.
Gov. Tim Pawlenty immediately said he would file papers opposing the controversial bill, setting Minnesota up as one of several states where the political leadership is divided over the legality of health care reforms that consumed the political debate in Washington, D.C., and the country, for much of the past year.
In a letter to Pawlenty — who had asked Swanson to consider joining several other attorneys general in challenging the legislation — Swanson said she concluded that a lawsuit over its constitutionality is “not warranted,” citing the federal government’s authority to regulate economic activity under the U.S. Constitution.
“Having carefully reviewed the applicable Supreme Court precedent and other legal authority, it is my legal opinion that health care — which comprises over one-sixth of our country’s economy — substantially affects interstate commerce,” Swanson wrote.
