Tennessee Atty. Gen. Robert E. Cooper says the legislature’s attempts to nullify the federal health reform legislation are likely unconstitutional and, as a result, he couldn’t attempt to enforce its efforts.
Unlike his counterparts in nearly two dozen other states who have filed court challenges against the federal act, Cooper’s advisory opinion Tuesday makes clear that if the legislature wants to challenge the reforms, it must hire its own lawyer.
