Federal Attorneys Claim AG Can’t Sue over Health Care

Cuccinelli lodged his complaint in March following passage of the federal health care law.

His case is partly built on the notion that the federal statute is at odds with a new state law exempting Virginians from a health care plan provision requiring the uninsured to obtain coverage or face penalties.

In Tuesday’s brief, federal government lawyers classify the Virginia law as “a naked attempt by a state to confer on its citizens an unauthorized exemption from federal law.”

Cuccinelli argues that Congress overstepped its bounds by imposing an individual mandate.
